City of McKinney Ordinance Changes

Information obtained from the City of McKinney Planning department:
At the April 19, 2011 City Council Meeting, the Council approved several changes to the Zoning and Subdivision Ordinances that will make development in McKinney easier and more streamlined opening the doors to future economic development in the City. By a vote of 6-0 (one member was absent), the City Council adopted an ordinance that created a conveyance plat process and modified when building permits for non-residential projects may be issued.

The conveyance plat process will allow property owners to record the remainder of a parent tract that is larger than five acres, and that is created by the record platting of a portion of the parent tract, provided that the remainder of the property is not intended for immediate development. The new plat process will also allow for the subdivision of property that is not intended for immediate development into parcels that are smaller than five acres provided that each parcel has direct access to all public infrastructure via a dedicated easement or adjacency to existing infrastructure.

The newly adopted ordinances will also allow City Staff to issue a building permit for a non-residential project that has received record plat approval. Previously, a building permit was issued only after required public improvements had been installed and a record plat had been filed for the property. In many cases, this required substantial financial outlays before a building permit was issued. Additionally, in the current economic climate, many financial institutions will not fund projects until a building permit is issued which prevents many developers from going forward with projects. The modification to the timing of building permit issuance should allow developers to more easily acquire funding in these difficult economic times.
